"To Seller's actual knowledge and belief, the mileage and/or hours indicated on any Equipment measuring device (to the extent such a device exists, e.g., an odometer/hub meter, etc.) is accurate; PROVIDED however, due to the model year and/or vintage of the Equipment, Seller makes no representation or guarantee regarding the actual mileage or hours of the various components of the Equipment (engine hours, frame hours, component hours, PTO hours, etc.)." All equipment is offered As is, Where is, without representations, warranties or covenants. Except for warranty of title, seller makes no other written, oral, express, or implied warranties as to the equipment or its specifications. The seller specifically disclaims all warranties, whether express or implied, including but not limited to the warranties of merchantability, performance, and fitness for a particular purpose for all equipment offered. The buyer shall determine for itself at its sole cost and expense, conducting appropriate tests, inspections, or other methods, whether the equipment is suitable for buyer’s needs (whether or not seller knows of such needs). The seller makes no representation as to any equipment certification and seller assumes no liability or obligation relating to the certification of the equipment or buyer’s failure to have such equipment certified in accordance with applicable laws. El comprador determinará por sí mismo, a su exclusivo costo y expensas, realizando pruebas, inspecciones u otros métodos apropiados, si el equipo es adecuado para las necesidades del comprador (Si el vendedor sabe o no de tales necesidades).
